3/15/2003 JUNEAU—Inspired by a resolution passed by the Fairbanks City Council, Senate
Minority Leader Johnny Ellis, D-Anchorage, is working on a Senate measure to condemn
encroachments on civil liberties resulting from the USA Patriot Act.
Ellis argues that the act, an antiterrorism measure that gave the federal government
broad new surveillance powers, infringes on citizens' constitutional rights.
"You can be patriotic without supporting everything in (U.S. Attorney General)
John Ashcroft's Patriot Act," Ellis noted. "For goodness' sake, they went too far."
Passed by Congress last year as an antiterrorism measure, the Patriot Act dramatically
increased federal search and surveillance powers. Spurred on by a broad local coalition
of concerned citizens, the Fairbanks City Council passed a resolution in December
expressing concern.
"We downloaded the resolution and I said, 'Wow, these people did a good job,'"
Ellis said. "I was very impressed with how moderates, liberals and conservatives
on that City Council joined together and made a real strong statement in favor of
civil liberties."
Ellis introduced a "Sense of the Alaska Senate" proposal during Thursday's Senate
floor session, a nonbinding statement that reasserts the Senate's commitment to
support the Bill of Rights.
"It is the sense of the Alaska Senate that we must not sacrifice our liberty
in the name of enhanced security or we may find that we have sacrificed both our
liberty and our safety, in which case terrorism will have prevailed," begins the
one-page document.
Senate President Gene Therriault, R-North Pole, declined to hear the measure,
telling Ellis he would prefer the sentiment to come in the form of a resolution,
a document that would be subject to votes of both the House and Senate.
Ellis said he would be asking Senate State Affairs Committee chair Gary Stevens,
R-Kodiak, to draft such a resolution. He said he would be "outraged" if the concept
doesn't get heard in committee.
"I believe this is so important for people's rights it should come for the floor
for a vote," he said. "I will be watching very carefully to make sure that the Republicans
and Democrats work together to get this bill to the floor."
